Every call to prove_merge checks whether the ecc_op block is empty and adds dummy ops if required to avoid issues. Therefore, there is no need to add dummy ops when creating mock circuits. This isolates the addition of dummy gates to two places: at builder finalisation and when necessary in prove_merge.

Yes, in circuit finalisation and prove_merge if necessary
