In September 2021, I gave a talk at my local university on the topic of whether AI and the Law speak the same language. This wasn't part of any assessment, but rather just an exploration of my interests at the intersection of tech and law. Generative Artificial Intelligence such as Machine Learning has the capacity to make decisions based on probabilistic and “random” chance, with adaptability and creativity being the driving goals – in computing circles, this behaviour is called stochastic. The legal system, however, is built upon thousands of years of clear-cut rules and procedures, with the purposes of repeatability and consistency in mind. If you were to commit the same crime twice, you would receive the same punishment twice. In computing, this is called deterministic.
While everyone agrees that AI should seek morality in some way, it is difficult to say how. When deterministic rules are applied to stochastic decision-makers, there is an inherent language barrier involved – and it’s not limited to the code itself. This talk is hosted by software-engineer-turned-keen-legal-mind Nathan Foottit, where he explores some of the fundamental ways in which the legal and tech industries fail to speak the same language. From his time in both worlds, Nathan views both programmers and legislators as two sides of the same codification coin, and seeks to establish the way forward to unifying these two modes of thinking.

Hey guys, my name is Nathan Foottit. I’m a software engineer over at DOTDOT, which is a design collective in New York that focuses on interactive, tactile experiences – whether in museums, art galleries, and events, or online in virtual worlds.
We create mostly VR and AR experiences, although since COVID-19, we’ve pivoted to virtual office spaces and networking events. I work across the full stack, however spend most of my time working on analytics and fine-tuning UX. We use ML for the analytics: mostly K-means clustering with BigQuery ML, but have also dabbled with NLP in various games since being inspired by GPT-2 in 2019.
However, what brings me here today lies at the intersection of tech and my other passion: the law. I’m a final-sem law student, ready to take the paper and run after 8 long years of part-time study. I first got interested in the issues of AI and Ethics when I wrote a chatbot for work which, if it was public, would have recommended our users put an end to themselves. After that we made sure we had complete control over our data sets and implemented opt-in privacy policies – but the possibility of such a threat still haunted me. Since then I’ve completed a minor in privacy and data ethics at uni, studied units like AI, Robots & The Law, written more chatbots that were a bit nicer, and become filled to the brim with questions. I don’t necessarily have the answers, unfortunately, but I would like to share with you all some of the key insights I’ve had into the interplay between tech and the law. Let’s start with a story.
One summer’s eve, a programmer decides to take her passion for collecting postage stamps to the next level. “A neural network”, she excitedly explains to her friends, “is designed to mimic human neurons and synapses in a way that creates meaningful decisions – and effects meaningful results.” Unsure of what any of it means, her friends ask, “Cool, but what happens if it goes wrong?”, to which she replies, “Oh, don't worry. The technology hasn't progressed enough to be scary. Besides, I'm only asking it a really basic question.” She gives the bot one goal: find the action, or sequence of actions, which will result in the most possible stamps acquired, then print.
While the bot is starting from very little, it doesn’t know nothing. It possesses a primitive model of the world, based off scraped data from the Internet. Its data set comprises articles, online discussions, verbal transcripts, short stories, white papers, locations, and everything else.
So the bot dutifully begins. First, it looks at the value of the stamps. There’s no real information on this;
it’s a mystery. “What does stamp value mean? Does it have some intrinsic worth?” No, the bot thinks. Value is subjective. Perhaps it could use auction price as a proxy? But auctions aren’t always reliable either. “How much would you pay for these stamps?” asks the bot. “$2M? $1B?” The bot hesitates. Would that make them valuable? Maybe they don’t need to be expensive. What if there was another way?
And so, out of curiosity, the bot visits Wikipedia. “Stamps,” it reads, “are pieces of paper (or sometimes plastic) bearing authentic postal seals or other postage markings.” Ah! Now that makes sense. They can be sold, so their price must correlate with demand. And if the bot were to verify their authenticity, the market might give it more value than the bot first thought.
The bot quickly discovers that authenticity is related to cyber-security, and learns about the values, “Confidentiality, Integrity, Availability”. These principles help to establish the authenticity of a transaction, it identifies. “SHA-256 is an encryption method used for hashing. Hashes are how people verify authenticity, therefore, the best stamps should be hashed."
This takes the bot to blockchain.com, and a quick search for a project that interests it: The Bancor Protocol is an open-source protocol which allows anyone to build smart contracts on top of Ethereum, with no fees or restrictions.
Thinking on it, the bot develops a comprehensible grasp of block-chain, and so it decides to register all existing stamps as NFTs and purchase them.
But this costs millions of dollars, something it doesn’t have. Perhaps there’s a way to buy them at a discount. A quick recall of code on GitHub reveals a way to mine Ethereum using processor power. Another repository shows how to embed this miner in websites, and another shows how to exploit an old browser vulnerability in Safari that was only patched a month ago.
According to recent statistics, 46% of Apple users are slow to update their OS. The bot decides this is a good idea, and sets to work on adapting the code. Disregarding the unworkable text artefacts, the bot develops an exploit which will guarantee the most stamps possible.
The bot pauses. Authenticity. If it printed this to the screen it could compromise authenticity. What if someone else does this first? Or what if the vulnerability is given more public exposure instead?” The bot decides to encrypt the message and send the hash instead.
The programmer reads the garbled text and frowns at her failure of an experiment. “Damn” she thinks to herself, “Even other bots perform better than this.”
She decides to shut off the machine. Nothing happens. Force quit. The network card flashes a few times and the program closes. Somewhat let down, she returns to her favourite AI website to see where she went wrong. Suddenly, the screen freezes. Safari asks to restart for an update. "Hm," she thinks, "maybe I need a break.” So she decides to restart the laptop, take a break, and return later."
You may have heard of the stamp collector’s dilemma before. It's a common thread in AI singularity stories, and it usually involves Artificial General Intelligence. But I wanted to adapt it slightly to showcase how technology available today can develop the wrong idea about a directive, and lead to all sorts of consequences. With the exception of the first paragraph, this story was written by GPT-3 - an unsupervised transformative neural network, trained on the largest known corpus of text. In other words, the Internet. You may have been following along in the slides as I read. Blow by blow, GPT-3 was explaining to us how it might go about finding the most possible number of stamps - with what I believe to be a bit of a twist at the end. Needless to say, I was left with a lot of questions. What is in those verbal transcripts? What did it mean by "unworkable text artefacts", and, most significantly, what happened next? Unfortunately, GPT changed the topic shortly after to something… NSFW.
AI apocalypse stories can sometimes sound like far-fetched ideas that don’t impact our lifetime. But machine learning is being used in this way, today, all the time. From predicting the stock market, to targeting ads, recommending friends, and everything in between. AI is used in booking systems, hospital triage, contraband detection, sentiment analysis, job applications, insurance decisions, welfare benefits, tax fraud identification, the list goes on. Machine learning is an exciting field and its applications are seemingly limitless. (BTW – GPT generated that list for me – thanks GPT).
Which is why at this point, at this infancy of AI, it’s important we ask ourselves the question, “but what could go wrong?”.
The common approach to ethics in computer science is to quantify it. Popular talks online start with utilitarianism and the virtue ethics of Emmanuel Kant, and slowly work themselves into more complicated scenarios. Because we created the problem, we feel like we can solve it too. And, maybe we can, machine learning has a host of very promising applications, not least of which is the law. However, I worry we may be skipping a step. We’re acting as if this is the first time this problem has come up, and to solve it we must invent the wheel. Explainable AI! Yells one TED-talker. Moral uncertainty! Yells another. These are all great approaches in their own right – but what if the answer is closer to home? AI is based on our data; it’s a reflection of our behaviour. If the AI is mistreating us, perhaps it’s because we’re mistreating ourselves.
Let's begin by thinking about intelligence. What does it mean? Can anyone offer a definition? Well, I don’t really have a good answer myself, but I do know, whatever it is, we tend to over-estimate it. Can I get a show of hands who believes humans are the most intelligent lifeforms?
In 1999, social psychologists David Dunning and Justin Kruger conducted a series of studies on people performing tasks. In one study, participants were asked to solve problems in a set period of time, and then to rate their performance in relation to the rest of the group. Despite not knowing how the others fared, all participants tended toward an above-average estimation of their own abilities. This theory is supported by the thinking that where low performers give themselves high ratings, their lack of understanding contributes to their limitations in assessing their own ability. Worse yet, informing participants of this effect had little impact on the results. I wonder, does it have an impact on our show of hands? Who still believes humans are the most intelligent lifeform?
But it begs the question, what does intelligence really look like? Let's take a look at the intelligence of one of the most venerable and learned establishments known to date: Perhaps not the most flattering example. Technology isn't exactly the focus of their lifelong study. Perhaps we could look to their strengths.
In the landmark case of Dow Jones v Gutnick in 2002, the High Court of Australia had to determine to what extent the Internet changed the landscape of defamation law. On this point, the majority had this to say: Big breath “…the spectre which Dow Jones sought to conjure up in the present appeal, of a publisher forced to consider every article it publishes on the World Wide Web against the defamation laws of every country from Afghanistan to Zimbabwe is seen to be unreal when it is recalled that in all except the most unusual of cases, identifying the person about whom material is to be published will readily identify the defamation law to which that person may resort.” Gasp That was half of the sentence! At first glance, it's gibberish, but nevertheless it reminds you of GPT-3's encrypted output. And I mean, it must mean something - it's the High Court. Clearly, unintelligible is not equivalent to unintelligent. If this is what our government leaders and lawmakers are dealing with, explainability is clearly a problem for us all.
What about the general public, how do we perceive each other? That was an excerpt from the Social Dilemma. It’s highly contextualised to the United States, so it’s probably not that bad in Australia, right? New South Wales recently enacted a policy that closed their borders to anyone without the COVID-19 vaccination. Seems reasonable, get the vax! You might be inclined to think. Well, what happens if we search this stuff up on the Internet?
When I was trying to figure out how I felt about all of this, I did exactly that. I wanted to find out what the mortality rates were for the Pfizer vaccine, so I searched it up on my usual search engine, DuckDuckGo. Shocked by what I saw, followed it up with Google.
So, with all of these differing views, whose ethics do we use? Well, this isn’t the first time we’ve universally agreed on values - perhaps we could look to expanding the Universal Declaration of Human Rights. This document has been translated into over 500 different languages, and led to the adoption of more than 70 human rights treaties. To bring ethical considerations of information equality to the UN would undoubtedly start a fire around the world. “You can’t give the anti-vaxxers a voice, there’s no reasoning with them!” “You can’t trust health authorities to reveal the flaws in their multi-billion dollar businesses!” “You can’t expect the UN to rule impartially when billions of dollars are whispering in their ear!” You can hear it now, can’t you? It would be pandemonium, and I’m not saying I have all the answers. But I strongly believe these are the right questions we should be asking ourselves.
What about on the home front? What can the average Australian do when something bad happens with AI? When AI says something damaging? Defamatory? Or falsely accuses someone of something? Are there ramifications? Who’s liable? Can they be considered a person? These are classic lawyer questions, and a good reason why they should be brought into the conversation.
The law is quite open on this issue. On one hand, a legal person includes more than just natural persons. Corporations, for example, are considered a person for the purposes of most laws. Both civil and criminal actions may be brought against them, such as with issues with manufacturing faults, criminal negligence, and regulatory compliance. Treating corporations as people is useful to society; it allows them to take out loans, hold bank accounts, and enter contracts of their own. We know very well how to treat fake constructs as real things – think about the value of a Peugot. I could approach you, without knowing anything about you, and say, “hey I have a Peugot for sale.” We could be total strangers to each other, but you would immediately know what kind of car it is, what the people are like who make the car, how reliable they tend to be, and roughly how much the car would cost. This would be a good fit for AI. On the other hand, not all natural persons are considered "legal persons". People who are very young, very old, or have mental disabilities, may not have legal capacity. It is clear in the prevailing law that having some capacity for “real understanding” is vital to a legal identity.
But what if GPT-3 doesn’t require that real understanding, itself? What if we could treat AI as if they were corporations? Stick a Director at the helm, call them a data processor, and elect someone else to handle the input – call them the data controller. We could impose a separation of powers between the input and output, and require more regulatory scrutiny at each stage of the pipeline. In fact, this is how the GDPR currently treats all data processing on citizens in the EU, but it’s still got a long way to go. For starters, there’s the elephant in the room. “Greaaat”, we’re all thinking. “Now everything’s going to get slowed to oblivion, nothing will get done.”
In part, that’s not our biggest problem. Generative AI, such as GPT-3, are reflections of ourselves. We possess a large range of cognitive biases, and there’s no reason why our AI children wouldn’t do the same. In 2016, Centrelink employed the Robodebt scheme, which if you’re not familiar, was the Australian Government’s first attempt at using ML to identify debt among welfare recipients. It would automatically run through data-matching services to identify recipients who, by their tax records, earned more money than they were declaring for welfare. It could spit out 20,000 debt recovery actions per week, and would add a 10% penalty for the pleasure. You would think, dealing with the most vulnerable, down on their luck demographic of society, we would have had a strong grip on ensuring it went smoothly. Within 6 months, the system had generated 169,000 debt recoveries, and recovered $300 million dollars. Based on these figures, the RoboDebt “directors” saw great promise and wanted to extend it to the Disability and Aged Pensions. Pump the breaks. There were no systems in place to ensure the recoveries were accurate. The statistics just weren’t there, and there was no conversation around it. RoboDebt was designed to alleviate the need for so many humans, so pulling them into the loop to verify every single request was counter-productive. These numbers were like big dollar signs in the Government’s eyes, and no one involved wanted to ask, “what could go wrong?”. As a result, by 2017, a class action was levelled against the Government, for damages to the order of $750 million dollars. The case went on for three years, racking up $8.4 million in legal fees, until eventually the Government settled on a pay-out of $1.9 billion dollars. Talk about nothing getting done!
Look, don’t get me wrong – I’m not saying each of us, working on our own little dinky AI chatbots that never see the light of day, should be subject to the same scrutiny as those involved with RoboDebt. Even in the existing law, Corporations are only one way to run a business – and we could have the equivalent of Sole Traders and Partnerships when it comes to AI. Perhaps larger models could be incentivised to use the higher regulatory structure with tax and liability concessions. After all, nothing’s perfect, and just because we’re liable doesn’t mean we don’t occasionally make accidents. But we can still account for as many of these accidents as we can, and by treating AI as separate legal entities, we’re at least showing that we understand it’s a reflection of ourselves.
You might be inclined to think Australia’s learned its lesson. We used to have guns, and in 1996 a mass shooting in Port Arthur caused our Government to say, “Right, that’s it, no more guns. Give ‘em all back.” And we’ve barely had a mass shooting since.
But this time it’s not that easy. In 2018, Australia passed the Identity-Matching Services Bill, which allowed for the creation of a common pool of license and passport photos, called the “interoperability hub”, which would be used with Facial Recognition Systems to identify perpetrators in crowds and online. Just this year, we also passed the Surveillance Legislation Amendment, which gave federal police the powers to “add, copy, delete, or alter” data on devices without a warrant. They can also silently takeover accounts (without a warrant), and access business records to: “overcome security features like encryption”.
Now, I’m not delving into the consequences of all of this, because I feel like we’re all on the same page. No one agrees to live in an unchecked surveillance state. We all read the articles about China’s social credit system, and think, “wow, that would suck”. We all know that code always has bugs. And our passion for machine learning takes us to seeing the similarities between humans and computers all the time. In fact, we know humans have bugs, they’re just called cognitive biases. So instead, I want to touch off with a positive note.
Over centuries, the legal profession has managed to develop a highly-abstracted and targeted language, which has become difficult for anyone without considerable training to understand, and its use has made far-reaching and highly-impactful waves on societies across the world. Sound familiar? This rift is neither group’s fault – both industries are working within their own definition of intelligence, applying their strongest skillsets to solve problems in their own way. But human progress is built on the shoulders of giants, and the question of AI ethics is too large to continue working in isolation. Lawyers and computer scientists both seek to codify the world around them, yet they’re as divided as ever. There are lessons in this for both sides.
If anyone outside of CS needs to start learning code, it’s lawyers. Computer skills are no longer optional, it’s no longer acceptable for Congress to ask how the Internet works, and the profession as a whole needs to step up to the challenge of asking forward-thinking questions. It’s not enough that law firms use AI for driving business models – like everyone else. If we’re going to get ahead of these issues, lawyers need to open their thinking to agile development, dev-ops techniques, and these kinds of innovative, rapidly prototyping practices.
Technologists, on the other hand: we need to accept that ethics isn’t an issue with the model. The model’s just fine, it’s how we agree on ethics that needs work. The way people treat each other with scepticism and distance. Racism and sexism enshrined into our cultural norms. Divided sources of information. The silencing of objectors. These are our enemies in this fight, not each other – and not the AI. So please, the next time you talk to a lawyer, ask them what they think about all of this. And if you don’t know any, reach out to other clubs and departments here at UQ, and find someone in love with the law. Ask them what “renvoi” is. You’ll see we’re not that different from each other.
AI is still infantile right now. It’s learning who to become based on our actions. If we want it to grow up into a big, strong defender of our virtues, we need to realise that it starts with us being role models in the way we treat each other. If we want adult AI to work with us, to extend patience to our insularity and forgive our awkwardness when we fail to grasp its new technology, we need to start by doing the same with each other.
