Description

Based on the code fixed, there was no support for the thematic break closing a list that was not in another list. This was done to ensure that a non-list code path would be handled properly, once encountered.

Actual Behavior

The non-tested path was finally encountered, triggering the assert.

Expected Behavior

The non-tested path needs implementation and testing to remove the assert.
