Empty Record File

Based on this example https://raw.githubusercontent.com/TwilioDevEd/api-snippets/master/twiml/voice/record/record-3/output/record-3.twiml, If the caller does not speak at all, the <Record> verb exits after 5 seconds of silence, falling through to the next verb in the document. In this case, it would fall through to the <Say> verb.. It does hangup after 5s but it still hitting the action endpoint and I can access an empty recording file. Is there a way to prevent this?
