Subscription note displays "new collection" section not consistently

Actions:
user 1: creates collection -> uploads items -> creates new subcollection ("primera untercollection") with items and a second subcollection ("2nda untercollection") (stays empty) -> shares with user 2 -> subscribe

user 2: uploads items

admin -> "tools" -> "send all pending notifications"

Observation: first subcollection is displayed in section "new collection", empty subcollection is not displayed

user 2: add new subcollection ("tercera untercollection") and upload items

Observation: new collection is not displayed in "new collection" section
-> Section "new collection" is not used in a consistent way

Expected result: all newly created subcollections are displayed in section "new collection" or section is not in use at all.
