Open Guard License (OGL) Version 1.0

This Open Guard License (OGL) Version 1.0 governs the use, modification, and distribution of software (hereinafter referred to as "the Software") released under this license. By using, modifying, copying, or distributing the Software, you agree to comply with the terms outlined in this license. This license is structured to provide comprehensive legal protection for creators and contributors while promoting transparency and responsible collaboration.

IMPORTANT: This license can only be used for open source projects. Any project licensed under this license must be open source, meaning that the source code must be made available to the public and the software must be freely usable, modifiable, and distributable.

  1. Disclaimer of Warranty and Limitation of Liability

1.1 Warranty Disclaimer: The Software is provided "AS IS" without any warranties of any kind, either express, implied, or statutory. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, title, and non-infringement. By using the Software, you acknowledge and agree that:

The creators, contributors, and any associated parties are not responsible for any form of warranty, and all warranties are explicitly disclaimed to the fullest extent permitted by law.
No assurances are made that the Software will meet your requirements, function without interruption, or be error-free. The user assumes all risks associated with the use of the Software.

1.2 Limitation of Liability: In no event shall the creators, contributors, or any affiliated parties be liable for any damages of any kind arising from the use or inability to use the Software, including but not limited to direct, indirect, incidental, consequential, special, punitive, or exemplary damages. This includes, but is not limited to:

  1. Grant of Rights

6.2 Enforcement of License: The creator(s) reserve the right to enforce the provisions of this license and take appropriate legal action against any party that violates the terms and conditions outlined herein.

  1. Severability and Governing Law

7.1 Severability: If any provision of this license is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from this license, and the remaining provisions shall remain in full force and effect.

7.2 Governing Law: This license shall be governed by and construed in accordance with the laws of the jurisdiction in which the original creator(s) reside. Any legal disputes arising out of or related to this license shall be brought exclusively before the courts of that jurisdiction.

  1. Future License Versions

The original creator(s) reserve the right to publish new or revised versions of this Open Guard License. Each version will be designated by a distinguishing version number. Users may continue to use the Software under this version or adopt any future versions of the OGL. However, the rights under future versions may not be applied retroactively.

  1. Entire Agreement

This license constitutes the entire agreement between you, the user, and the creator(s) of the Software. Any prior agreements, oral or written, regarding the Software are superseded by this license.

  1. User Responsibility and Compliance

10.1 User Responsibility: As a user of the Software, you are solely responsible for ensuring that your use of the Software complies with all applicable laws, regulations, and third-party agreements. The creators and contributors of the Software will not be held liable for any illegal or unauthorized use of the Software.

10.2 Compliance with Third-Party Licenses: If the Software incorporates third-party components or libraries, you are responsible for ensuring compliance with their respective licenses. The creators and contributors are not liable for any violations of third-party licenses arising from your use of the Software.
